West Ham have reversed the problems that Sheffield Utd gave the Hammers since the end of season 06/07.
It is now West Ham who are pushing for justice and have gone to the CAS to find it. The CAS have agreed a preliminary hearing to decide whether they will hear the appeal in full.
Sheffield Utd have been given 24hrs to provide and arbitrator for the hearing and if they fail to provide one then the CAS will appoint one.
West Ham have appointed an arbitrator for themselves who will provide a 12 page legal document that argues a case for West Ham and the ‘Right of Appeal’ to which they have not been given, and Sheffield Utd had twice over.
If all fails with the CAS then West Ham are seeking permission from Fifa to take the case to the High Courts.
Sheffield are claiming for a loss of earnings since their relegation for amount of £30m to £50m when the true cost of their loss is around £1.3m loss of profits as stated here.

The very words that McCabe used whilst speaking to the Media before the FA arbitration decision was ” Its not about the money, its all about justice ” words that would be spoken by a man of great honour.
The FA arbitration panel found the case in favour of Sheff U, and the decision was made on the grounds that Tevez was responsible for at least 3 points in the final 3 games played in the season 06/07.
Obviously McCabe will be happy that the decision was found in his clubs favour, but he must have wanted the decision to be based on fact and not on something that our very own prediction panel could have mustered up.
The CAS rules state that an arbitration hearing has to be agreed to by both parties for a hearing to take place, so West Ham will challenge McCabe to 1 more arbitration panel by the CAS and by doing this, McCabe will prove to his clubs fans and media he is a man of honour, If West Ham lose then we should pay the £30m deficit lost by Sheff U, but if they lose then McCabe should call it a day and keep to his words “Its not about the Money, Its all about Justice”.

When other sites were saying West Ham cannot appeal against the decision made by the FA arbitration panel, COYI wanted everyone to realise that we could appeal by going to the CAS.
We are West Ham, we fight for what we want and we have done for decades, whether it be promotion, justice, or to be a club that the world will think of as the club that saved Football.
The arbitration panel awarded the case to Sheff U on pure speculation and nothing else, the decision is a mockery to justice and football and also opens the doors to 100’s of claims that can and will be made against the bad referee decisions that determine the fate of clubs at the end of season from all around the world.
The Panel said Tevez alone contribited at least 3 points for West Ham to stay up, a referees bad decision could also be the loss of a point that relegates a team, and as we all know, referees make bad decisions every week.
By West Ham taking this to the CAS and hopefully winning we may just see the future of football being saved from turmoil and 100’s of end of season court cases and arbitration panels and only your imagination can understand the damage made to Football in general.
I am so grateful we have a chairman/owner like Bjorgolfur Gudmundsson and his legal staff that will again fight for West Ham until the bitter end.

Sheffield Utd have not finished they are still in the process of suing the Premier League.
Sheffield United argued that West Ham won at least three points inspired by Tevez during the 2006-07 season, when the Tevez was illegally registered at West Ham.
We have to remember that the hearing has so far only said they find in favour of the little fizzy pop league club and no financial award has been given, the award of payment will be fought out for months to which West Ham can accumulate more interest on the money before parting with what will be agreed by both clubs, and there is a possibility by West Ham to appeal by registering an appeal against the decision to the Court of Arbitration for Sport in Lausanne, something i am sure the legal bigwigs at West Ham are already considering.
Sheffield Utd are still in the process of suing the Premier League because they feel that justice was not served in the 2007 hearing by the Premier League where West Ham were fined £5.5m and Sheff U stayed relegated.
It is not possible to deduct points from West Ham now and also impossible for Sheff Utd to be promoted, and to be honest, looking at the stats for Sheffield Utd and the amount of good players that have jumped ship, it could be a few more seasons until they find their way to top class football.

Whatever happened to the Gang of 4? those maggots that wanted West Ham to be deducted 10pts at the end of last season, and even threatened legal action, to which Sheff Utd were the only ones to carry it, out even to this day, the other 3 backed off like scared little weasels.
Fulham - 6 games to go. 3 Away, and 1 against Liverpool, not a lot of chance of surviving.
Wigan - 6 games to go and 4 of those games against good clubs. Man Utd, Chelsea, Spurs, and Villa. so its a good chance of relegation for them.
