FA to investigate Sheffield United over Kabba Clause?

West Ham agreeably broke the rules of football and paid a massive sum of £5.2m a record fine for any club, and are still suffering to this day.

The FA should now hold inquiries into every club in all leagues regarding transfers and rules that have been broken, and especially rule U18.

Sheffield Utd without doubt broke this rule and influenced the outcome of the game between Watford and Sheffield Utd a clause was inserted into the transfer contract that Steve Kabba could not play for Watford in the game against Sheffield Utd.

The U18 rules says: “No club shall enter into a contract which enables any other party to that contract to acquire the ability materially to influence its policies or the performance of its teams in league matches or in any (other) competitions.”

So rule U18 was breached under this contract, McCabe has stated recently that Kabba not playing for Watford in that game was only a gentlemen’s agreement.

Both clubs Websites Sheffield Utd and Watford at the time had stated that Kabba was not playing in that game and the page has since been removed from Sheffield’s Website it did state:

Meanwhile, in the Watford camp, striker Steven Kabba is ineligible to play in this weekend’s fixture due to a clause in his £500,000 move from Bramall Lane in January.

Sheffield United went on to win the game 1-0 and in the view of the FA Kabba not being involved in the game was a direct influence on the win.

Rule U18 was breached and investigations should commence by the FA into not only Sheffield Utd but also every club that made an agreement and clause that influences the outcome of a game by not fielding an important player after a transfer.

West Ham have reversed the problems that Sheffield Utd gave the Hammers since the end of season 06/07.

It is now West Ham who are pushing for justice and have gone to the CAS to find it. The CAS have agreed a preliminary hearing to decide whether they will hear the appeal in full.

Sheffield Utd have been given 24hrs to provide and arbitrator for the hearing and if they fail to provide one then the CAS will appoint one.

West Ham have appointed an arbitrator for themselves who will provide a 12 page legal document that argues a case for West Ham and the ‘Right of Appeal’ to which they have not been given, and Sheffield Utd had twice over.

If all fails with the CAS then West Ham are seeking permission from Fifa to take the case to the High Courts.

Sheffield are claiming for a loss of earnings since their relegation for amount of £30m to £50m when the true cost of their loss is around £1.3m loss of profits as stated here.

A Post From a concerned West Ham Fan

How come Sheffield United are claiming between £30 million and £50 million in damages flowing from relegation?

Sheffield United made an operating profit of £2.6 million in the 2006-07 season (their last season in the Premier League) and an operating profit of £1.3 million in the 2007-08 season (their first season, post relegation, in the Championship). Source, the Sheffield United website.

Hence the true measure of their loss is £1.3 million loss of profits. I’m sure West Ham would gladly pay that amount to get Sheffield to go away.

The 6 players to go in January!

A financial crisis has hit West Ham and the club will respond accordingly, we may even see a substantial rise in ticket prices next season if a massive payout is awarded to Sheffield Utd, until then like any business we have to slimline the club to balance the books.

Zola has said he prefers Quality to Quantity so the 6 players we at COYI feel that should go in January are Danny Gabbidon, Nigel Quashie, Calum Davenport, Jonathan Spector, Lee Bowyer and Luis Boa Morte.

The only other answer to our problems is that BG sells the club to another billionaire.

Sheffield Utd: McCabe a man of Honour?

The very words that McCabe used whilst speaking to the Media before the FA arbitration decision was ” Its not about the money, its all about justice ” words that would be spoken by a man of great honour.

The FA arbitration panel found the case in favour of Sheff U, and the decision was made on the grounds that Tevez was responsible for at least 3 points in the final 3 games played in the season 06/07.

Obviously McCabe will be happy that the decision was found in his clubs favour, but he must have wanted the decision to be based on fact and not on something that our very own prediction panel could have mustered up.

The CAS rules state that an arbitration hearing has to be agreed to by both parties for a hearing to take place, so West Ham will challenge McCabe to 1 more arbitration panel by the CAS and by doing this, McCabe will prove to his clubs fans and media he is a man of honour, If West Ham lose then we should pay the £30m deficit lost by Sheff U, but if they lose then McCabe should call it a day and keep to his words “Its not about the Money, Its all about Justice”.

The Flood Gates have Opened!!

The floodgates have opened for just about anybody that feels hard done by because of the Tevez saga, to seek legal advice and probably sue West Ham.

A ridiculous decision made by the FA arbitration panel has put the world of football into chaos, a decision that Lords High Court Judges and QC’s find unbelievable.

It now seems that 10 Sheffield Utd players are considering suing West Ham for loss of pay bonuses not being a premier league club, West Ham playing Tevez in the final games, to which they presume the reason they were relegated, not the fact they was not good enough to beat Wigan, Sheffield Utd lost 8 of their last 11 games, to me that proves they were on a downward spiral to be relegated and had nothing to do with Tevez.

When will this end, The FA need to make a statement and it needs to be urgent or they too could be sued for some pathetic unsubstantial reason.

West Ham still have ‘Rights to Appeal’ - Sheffield Utd may still Lose!

The FA have said West Ham have no rights to appeal under the FA Rules, the FA Rules only apply to the FA and not Sport in General.

West Ham still have the right to appeal at CAS (Court of Arbitration for Sport) in Lausanne, which is where many football teams go to after arbitration hearings and where i am sure Sheffield Utd would have went if they had lost.

As of 2004, the majority of recent cases considered by the CAS dealt with transfer disputes within professional football.

Struggling Sheff Utd to get what they Deserve

And that is Sweet FA.

For some strange reason, struggling Sheffield Utd are under the presumption that they will be getting £30m from West Ham.

The facts are that Sheffield Utd will be getting absolutely nothing for their own mishap of not winning or drawing the final game of 2006 season, they made their own destiny by believing West Ham would lose to Man Utd, the season where West Ham beat Man Utd and Arsenal both home and away.

Sheffield Utd owner cry baby McCabe has made the poor struggling club suffer since the day they were relegated, instead of concentrating on promoting success to the club in way of promotion back to the Premier League, he gave them promises of Re-Promotion which never progressed and humiliated the club to an extent where other clubs cut themselves off from the original plan to sue West Ham, so they had to do it alone, and failed every time.

My advice to Sheff Utd is concentrate on promotion and try to seek revenge in a way that makes you proud again, not that you ever will!!

There are many who are saying we will struggle next season, and that there will be no major signings, which will be our downfall.

Personally I am not worried, nor will I be drawn into negativity. What we have to realise is that we have this Sheffield utd lot stalking us like Michael Myers did to Jamie Lee Curtis. Plus we have to offload some players that really don’t belong at the club. Plus we have the injury issue that is being addressed, and if what is written is true, then Nani is sending the injury
prone to Milan for assessment.
